Welcome to Rock n Scroll Guitars
Please take care and time to read our terms and conditions, as they form a legally binding
contract between the vendor, buyer and Rock n Scroll Guitars.
1. Rock n Scroll Guitars will not accept any alterations to the below terms and
conditions or any variation thereof, unless they have been agreed in writing by Rock n Scroll Guitars
2. In these conditions Rock n Scroll Guitars will place items for auction solely with
invaluableauctions.com and auctionzip.com
3. In accepting these terms and conditions the vendor agrees to be bound by the
terms and conditions of invaluable.com and auctionzip.com applicable at the time of submitting the item(s) and the sale date.
4. Rock n Scroll Guitars charge a commission of 15% of the hammer price on each
lot we sell. Unsold lots levy no fee unless previously arranged.
5. Descriptions and photographs of lots to by entered for auction are to be provided
by the vendor. It is the vendor's responsibility to provide information pertaining to the
authenticity, origin, age and condition of any lot. Any changes made by Rock n Scroll Guitars to either images or text description, as provided by the vendor shall be agreed between Rock n Scroll Guitars and the vendor, prior to items being submitted into the online catalogue.
6. After submission of an item, should the vendor withdraw the aforementioned item
for sale without the agreed written permission of Rock n Scroll Guitars, a withdrawal
charge is levied at a flat rate of 20% of the low estimate. Withdrawal of an item post
auction will incur the standard 15% commission rate fee of the final auction hammer
price.
7. Each lot is offered for sale subject to any reserve price placed by the vendor. In the absence of a reserve price, Rock n Scroll Guitars shall start the lot price at a pre-
determined value, which will be clearly displayed via the online catalogue prior to the
auction. Rock n Scroll Guitars have the absolute discretion to withdraw any lot(s) from
sale without in any case giving any reason and without previous notice.
8. Notwithstanding any other terms and conditions, if within 10 days of the sale,
Rock n Scroll Guitars have received from the buyer of any lot, notice in writing that in
the buyers view the lot is a deliberate forgery, and within 14 days after such notification
the buyer returns same lot, in the same condition as at the time of sale and by producing
evidence, the burden of proof on the buyer, satisfies Rock n Scroll Guitars that
considered in the light of the entry in the catalogue, the lot is a deliberate forgery, then
the sale of the lot will be rescinded, and the purchase price of the same refunded, not
including the buyer's premium. The seller agrees that all costs, including the seller's
commission be paid by the seller to Rock n Scroll Guitars in this instance. In the event
of a dispute, the matter shall be settled by arbitration. Both the buyer and the seller agree
to be bound by this decision. In addition any lot determined to be a deliberate forgery or
suspected to being so by Rock n Scroll Guitars may be withdrawn at Rock n Scroll Guitars total discretion.
9. The vendor shall duly indemnify Rock n Scroll Guitars against any claims in
connection with any goods sold by Rock n Scroll Guitars on the vendor's behalf. In case
of a rescinded sale, the vendor warrants that he is entirely responsible for the repayment
of the buyer's premium, in addition to the hammer price.
10. The buyer shall be electronically invoiced by Rock n Scroll Guitars through
invaluable.com or auctionzip.com integrated payment system. By bidding through either of these sites the buyer accepts and is bound by their buyer's terms and conditions, as
well as Rock n Scroll Guitars terms and conditions. A buyer's premium of 15% shall be
added to the purchase to reach the total sales price. The total sale price includes (i) The
hammer price of the item (ii) The buyer's premium (iii) applicable sales taxes due on
account of the sale (iv) Packing, shipping transportation and shipping insurance charges.
The buyer also agrees to pay any import and customs fees and duties, needed to release
the item to them, after the item has been shipped. Any risk of loss during shipment will be
borne by the buyer. Acceptable forms of payment shall be listed on each lot detail. The
buyer shall communicate with Rock n Scroll Guitars within 72 hours of the conclusion of
the auction. Completed payment of the total sales price shall be received by Rock n Scroll Guitars no later than 7 days after the conclusion of the auction. The vendor is
solely responsible for arranging and shipping to the buyers designated address. The
vendor is solely responsible for arranging insurance as requested and paid for by the
buyer. The vendor is solely responsible for the adequate packaging of the item, as
stipulated by the designated courier. Rock n Scroll Guitars accept no liability for damage
or loss of goods in transit.
11. Payment for the item including hammer price, shipping and insurance costs and
minus 15% of the hammer price (sellers premium) shall pass from Rock n Scroll Guitars
to the vendor, no later than 48 hours after buyer receives item from vendor. Payments
from Rock n Scroll Guitars to vendors will be transferred in the vendors preferred
currency (subject to business exchange rates at the time of transfer) It is the vendors
duty to ship the item within 48 hours of receiving notice of buyers completed payment
from Rock n Scroll Guitars.
12. The maximum sum of Rock n Scroll Guitars liability for any reason e.g.
negligence, breach of obligation or other, shall be the successful bid of any price of any
lot. If the auction has not been completed Rock n Scroll Guitars accept no responsibility
to the buyer to the fullest extent permissible by English law.
13. For auction purposes all bid increments and final prices will be calculated in
GBP.
14. These terms and conditions shall be governed by and construed in accordance
with English law and the English courts shall have exclusive jurisdiction over any dispute
which may arise.
